Advocacy work to bring modular into our legal landscape
Our Founding Partner, Jessica Rippon, has also been directly involved in shaping the regulatory framework modular delivery depends on, preparing stakeholder submissions on the Building (Approvals and Practitioners) Act 2026, recent legislation that introduces a new approval and certification pathway for prefabricated and land lease homes, along with a formal dispute resolution scheme for defect disputes. That involvement means our advice isn’t reactive. We understand not just what the legislation says, but why it says it, including where the gaps and ambiguities still sit while the detailed regulations are developed.
The reforms introduce a statutory definition of prefabricated building, manufacturer declarations and instructions, a supply-chain chain of responsibility, staged approvals, and mandatory dispute resolution for defect disputes. Clients don’t need to wait for every regulation to be finalised before they plan; they need advice on what applies now and how the framework is likely to land on their specific product and delivery model.
Experience in this space matters because modular isn’t simply conventional construction moved into a factory. It shifts where value is created, how risk is allocated, and what needs to be in the contract.
In a conventional build, most of the value is created progressively, on site, where it can be inspected as it goes. In a modular project, a large share of that value is created, and paid for, in a factory, often before a module ever reaches the site. That single shift raises questions that standard construction contracts were never built to answer: who owns a module while it’s mid-manufacture, when does title actually pass, what happens if the manufacturer goes under halfway through the run, and who wears the risk if a module doesn’t fit the core once it’s on site.

We think modular and offsite construction has a genuine role to play in solving Australia’s housing supply problem, i.e. faster delivery, more predictable quality, safer work practices, and a real cut in construction waste. But none of that happens automatically. It happens when the legal and commercial structure is built for the way the project is actually delivered, not retrofitted after the fact.
